Welcome to the Mold Inspection & Testing ("MI&T," "we," "us," or "our") website and services. By accessing or using our website, scheduling an inspection, or otherwise engaging with our services, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Acceptance of Terms

By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy. If you do not agree to these terms, please do not use our website or services.

2. Description of Services

Mold Inspection & Testing provides independent mold inspection and testing services, including visual inspections, air quality sampling, surface sampling, moisture detection, and laboratory analysis. MI&T is a test-only company and does not perform mold remediation, removal, or abatement services.

Our inspectors will conduct a professional inspection of the designated property and collect samples as deemed appropriate based on the conditions observed. All samples are sent to accredited third-party laboratories for analysis. Results are provided in a written report, typically within three (3) business days of the inspection.

3. Scheduling and Appointments

Appointments may be scheduled by phone, email, or through our online scheduling form. All appointments are subject to availability. We will make reasonable efforts to accommodate your preferred date and time. You will receive a confirmation of your scheduled appointment.

If you need to cancel or reschedule an appointment, please contact us at least 24 hours in advance. Failure to provide adequate notice may result in a cancellation fee.

4. Pricing and Payment

Service pricing is displayed on our pricing page and may vary based on the type of inspection, property size, number of samples, and location. Final pricing will be confirmed prior to the inspection. Payment is due at the time of service unless other arrangements have been made in advance.

We accept major credit cards and other payment methods as communicated at the time of booking. All fees are non-refundable once the inspection has been conducted and samples have been submitted to the laboratory.

5. Scope and Limitations of Inspection

Our mold inspections are limited to the areas accessible and visible at the time of the inspection. Inspectors will not move furniture, stored items, or personal belongings, and will not make cuts or openings in walls, floors, or ceilings unless specifically agreed upon in advance.

Our inspection and testing services provide information about the presence and concentration of mold at the time of sampling. Mold conditions can change over time due to environmental factors. Our reports represent conditions observed at the specific time of the inspection and should not be interpreted as a guarantee of future conditions.

MI&T does not provide medical advice. If you are experiencing health symptoms that you believe may be related to mold exposure, we recommend consulting with a qualified healthcare provider.

6. Property Access and Authorization

By scheduling an inspection, you represent and warrant that you have the legal authority to grant access to the property being inspected. You agree to provide our inspector with reasonable access to the areas to be inspected, including access to the property's HVAC system, attic, basement, crawlspace, and other relevant areas as needed.

7. Hazardous Conditions

Some inspection areas, such as attics, crawlspaces, and areas with known water damage, may present hazardous conditions. An additional hazardous area fee may apply as listed on our pricing page. Our inspectors reserve the right to decline to enter any area that they determine to be unsafe.

8. Laboratory Reports

All laboratory analysis is performed by accredited third-party laboratories. While we stand behind the quality of our sample collection procedures, MI&T is not responsible for errors or omissions in laboratory analysis. Laboratory reports are provided as received from the lab and represent the lab's independent findings.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MI&T, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of our services, including but not limited to damages for loss of profits, property damage, personal injury, or any other claim arising from the use of our inspection reports or recommendations.

Our total liability for any claim arising out of or relating to our services shall not exceed the amount paid by you for the specific inspection service giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless MI&T and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or relating to your use of our services, your violation of these Terms, or your violation of any rights of a third party.

11. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Mold Inspection & Testing or its content suppliers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.

12. Website Use

You agree to use our website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use of the website. You may not use our website to transmit harmful, threatening, or otherwise objectionable material, or to attempt to gain unauthorized access to our systems.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the courts located in Denver County, Colorado.

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to this page with a revised "Last Updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
